There was long standing legal uncertainty regarding the possibility for third parties to a contract to claim tortious liability for breach of contract.
In a 2020 ruling, the plenary session of the Court of Cassation laid the groundwork for the admissibility of tort claims brought by third parties against a party to a contract, in the event that such breach causes them damage.
